This afternoon, Circuit Court Judge Douglas Barnett threw out the two lawsuits filed on November 23, 2022, by Grant Park Capital, LLC, against the City of Baltic and City Officials.
The Judge granted the City’s motions to dismiss the two lawsuits, ruling that approval of a plat does not mean the City has accepted responsibility for the developments and that the City Officials, and not the Court, have jurisdiction over the Developer.
A third lawsuit was filed on February 7, 2023, by Grant Park Capital against the City and City Officials, and the City has filed a motion to dismiss that lawsuit as well, but no hearing has yet been scheduled.
